According to the statistics of the National Health Insurance (NHI) dispute mediation committee, there were 1,901 applications filed by the insured from 2002-2005 and the overruled rate was 10%; whereas 347,271 were filed by the health care providers and 25% overruled. With this amount of grievance claims, the staff of the NHI shouldered enormous legal pressure and the need of administrative law knowledge cannot be overemphasized. Although the NHI Act has been revised several times in the past, the scopes of revision were quite limited, mainly focused on the inclusion criteria, broadening premium bases and protecting the economically disadvantaged. The most recently promulgated NHI Act of January 26th, 2011 has 104 articles. Structurewise, it is a brand new second generation NHI Act in that it has grown to have 11 chapters and 104 articles from the original 9 chapters and 89 articles. At least 30 implementing regulations need to be modified or codified by initial estimate. The changes are indeed great. And right now is definitely a good time to strengthen the NHI staff’s legal knowledge and establish a digital knowledge platform. In order to strengthen the law abiding ability of its staff and to integrate the experiences and expertise of internal and external experts in order to help solve the problems the NHI staff faces in their operations, the Bureau of NHI (BNHI) intends to establish an e-learning and interactive digital legal knowledge platform. The objectives of this project include: provide at least 5 legal courses and one seminar according to the needs of the NHI staff; digitalize those courses and seminars to facilitate searching; establish the exchange mechanism among the internal and external experts in order to provide online consultation, at least providing 5 case studies to undergo discussions which will be computerized and will help out the staff’s daily practices and the decision making of the BNHI. An e-learning knowledge platform will be constructed to store lectures, seminars and on-line consultations. An online evaluation mechanism will also be installed. Our research team consists of primarily scholars from Taipei Medical University and Taipei Union University System. Experts from the Society of Law and Medicine, the Institute of Law for Science and Technology (ILST) of National Tsing Hua University, the Chinese Law Society and HeimaVista Inc. will also participate in this project. We aim at providing teaching and online consultation through needs assessment, system analyses and expert consultations. Specific tasks include establish consultation platform, organize operational teams and effectively integrate the consultation platform and knowledge management platform. Online consultation is designed to be initiated by posting the questions on line. Based on the interactive mechanism of Web 2.0, members can discuss the issues according their authorizations. All parties are welcome to volunteer their answers and the experts will also provide theirs. The efficacy of learning will multiply through interaction. Telephone call meetings and video meetings can be arranged if needed to facilitate in depth discussion.
